Trade only
Porcemall sells exclusively to approved trade accounts. Porcemall does not sell to consumers. Nothing on the website is an offer to sell, a price or an invitation to order. No product may be ordered through the website. Availability, pricing and all terms of sale are established solely by written agreement between Porcemall and an approved trade account.
Trade applications
Submission of a trade application creates no obligation of any kind on Porcemall. Porcemall may approve or decline any application, and may close any account, at its sole discretion and without stating a reason.
Product information
All product information on the website, including descriptions, dimensions, technical data, ratings, images and availability, is provided as is, for general reference only. It may contain errors and may change or be withdrawn at any time without notice. Porcemall makes no representation that any information on the website is accurate, complete or current. Only a written confirmation issued by Porcemall for a specific order governs that order.
Colour and variation
Images on the website do not represent the product you will receive. Variation in shade, tone, finish, texture, size and calibre between production runs, and within a production run, is inherent in ceramic, porcelain, vinyl and laminate products and is not a defect. The purchaser is solely responsible for inspecting all material, confirming shade and lot, and rejecting it before installation. Installation constitutes acceptance. No claim relating to shade, tone, finish, size or calibre will be accepted after installation.
No warranty
The website and all products are provided as is and as available. To the fullest extent permitted by law, Porcemall disclaims all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title and non-infringement. The only warranty on any product is the manufacturer's limited warranty on SPC and LVT vinyl flooring set out in the warranty letter and the warranty application rules, which constitute the entire warranty and are subject to their own conditions and exclusions. No other product carries any warranty. No statement on the website, by any Porcemall representative or by any dealer creates a warranty.
Intellectual property
All content on the website, including images, renderings, text, guides, documents, designs, code and the selection and arrangement of the website, is the property of Porcemall or its licensors and is protected by copyright, trademark and other laws. No licence or right in any content is granted. No content may be copied, reproduced, distributed, displayed, modified or used for any purpose without the prior written consent of Porcemall. Any use of Porcemall content by a dealer is permitted only under a separate written agreement and may be withdrawn at any time.
Trademarks
PORCEMALL and the Porcemall logo are trademarks of Porcemall USA Corp. All other names and marks appearing on the website belong to their respective owners. No right to use any mark is granted.
Third-party sites
The website may link to sites operated by dealers, manufacturers and others. Porcemall does not control those sites, does not endorse them and is not responsible for their content, their practices or their prices and terms.
Limitation of liability
To the fullest extent permitted by law, Porcemall, its officers, directors, employees, agents and suppliers shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, business or data, or for the cost of removing, replacing or reinstalling any product, arising out of or related to the website, its content, any product or any reliance on either, whether in contract, tort or otherwise, even if advised of the possibility of such damages. In no event shall Porcemall's total liability arising out of the website exceed one hundred US dollars.
Indemnity
You agree to indemnify and hold harmless Porcemall and its officers, directors, employees and agents from any claim, loss, liability or expense, including reasonable attorneys' fees, arising out of your use of the website, your breach of these terms or your infringement of any right of Porcemall or a third party.
Governing law and venue
These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any action arising out of or relating to the website or these terms shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts. If any provision of these terms is held unenforceable, the remaining provisions remain in full force.
