Privacy Policy

1. Scope

This Privacy Policy describes how Porcemall USA Corp ("Porcemall") collects, uses and discloses personal information through porcemall.com, its forms, the emails sent through them and the QR codes that lead to it (the "Website"), and through the Porcemall app for Android (the "App"). It does not apply to information collected offline, in the course of a sale, or by any third-party website or service. Use of the Website is also governed by the Terms and Conditions.

The Website is operated from the United States and is intended for use in the United States. Information is processed and stored in the United States.

2. Information collected

Porcemall collects the following information:

• Contact form. Your name, email address, telephone number (optional), the description of yourself you select, your message and the language of the page.
• Trade account request. Your first and last name, email address, telephone or WhatsApp number, city, state, country, message (optional) and the language of the page.
• Newsletter signup. Your email address, the language of the page and the form you used.
• Emailed favorites list. Your email address and the list of saved products your browser sends so that the email can be prepared.
• Correspondence. Whatever you include when you email, call or write to Porcemall.
• App accounts. The details you enter to create and use an account in the App.
• Technical information. When you visit the Website, Porcemall's hosting and content delivery providers automatically receive and log technical information, including your IP address, browser and device type, the pages and files requested, the referring page, and the date and time. The forms also use your IP address and the time a form was loaded and sent to detect automated submissions and limit abuse.
• QR code scans. When a Porcemall QR code is scanned, the code, the date and time, the browser and device type, the referring page (if any) and an approximate country derived from the IP address are recorded. The IP address itself is not recorded in that log.

The Website does not ask for payment card numbers, bank account numbers, government identification numbers or passwords. Do not send them through any form.

3. How information is used

Porcemall uses personal information to respond to inquiries and requests; to evaluate trade account requests and conduct business with customers; to send the emails you request, including confirmation copies and favorites lists; to send the newsletter to subscribers; to operate, maintain, secure and improve the Website and the App; to detect and prevent spam, fraud and abuse; to comply with law and legal process; and to establish, exercise and defend legal claims and protect Porcemall's rights.

Porcemall does not sell personal information and does not disclose it to third parties for their own marketing purposes.

4. Service providers and other disclosures

Porcemall discloses personal information to service providers that process it on Porcemall's behalf, including:

• Vercel Inc., which hosts the Website, delivers its pages and product images, runs its forms and QR code redirects, and logs technical information about each request.
• Supabase Inc., which hosts Porcemall's product database, product images and documents, and stores the QR code scan log. Product images reach your browser from porcemall.com, which obtains them from Supabase itself, so your browser does not contact Supabase to display them. Brochures and other PDF documents linked from product pages open directly from Supabase, and the product pictures in an emailed favorites list are loaded from Supabase by your email program; in those cases Supabase receives the technical information described above.
• Resend (Plus Five Five, Inc.), which delivers the emails the forms send, including the copy to Porcemall's office, the copy to you and the favorites list.
• Mailchimp (The Rocket Science Group LLC, an Intuit company), which holds the newsletter list and sends the newsletter and its confirmation emails.
• Porcemall's business email and information technology providers, which host the mailbox that receives form submissions.

The Website does not keep a database of form submissions. A submission is delivered by email and is kept in Porcemall's business email and in the records of its email delivery provider.

Porcemall may also disclose personal information to its professional advisers; with your consent or at your direction; when required by law, subpoena, court order or government request; when Porcemall believes disclosure is necessary to protect its rights, property or safety or those of others, or to investigate fraud or misuse; and to an actual or prospective acquirer, successor or financing source in connection with a merger, acquisition, financing or sale of all or part of Porcemall's business or assets.

5. Email

A newsletter signup is sent to Mailchimp, which may email you to confirm the subscription, or, if Mailchimp is unavailable, to Porcemall's office to be added to the list. Every newsletter contains a link to unsubscribe, and you may also unsubscribe by writing to infousa@porcemall.com. Unsubscribe requests are honored as the federal CAN-SPAM Act requires. Unsubscribing does not stop emails that respond to a request you make.

6. Cookies, local storage and analytics

At the effective date of this policy, the Website does not set cookies of its own and does not use advertising pixels, social media plugins or analytics services. Porcemall's hosting and content delivery providers may set cookies or use similar technologies that are necessary for security, bot protection and the delivery of content.

Favorites. Products you save as favorites are stored in your browser's local storage, on your device. The list is not sent to Porcemall unless you ask for it to be emailed to you. You can remove it by removing the saved products or clearing your browser's data for the Website.

Analytics. Porcemall may add analytics tools, such as Vercel Web Analytics, to understand how the Website is used. Such tools collect information such as the pages viewed, referring websites, browser, device and operating system, and approximate location, and may use cookies or similar technologies. If Porcemall adds an analytics tool, this policy applies to the information it collects and Porcemall will update this section.

Other parties. At the effective date of this policy, no third party collects personal information about your online activities over time and across different websites through the Website.

7. Do Not Track

Some browsers send a "Do Not Track" or similar signal. The Website does not respond to those signals. At the effective date of this policy, the Website does not track visitors over time across third-party websites.

8. Retention

Porcemall keeps personal information for as long as it considers reasonably necessary for the purposes described in this policy, including for as long as it does business with you, and for as long as required or permitted for legal, tax, accounting, record-keeping, dispute and enforcement purposes. A newsletter address is kept until it is unsubscribed, after which it may be kept on a suppression list so that it is not emailed again. Service providers keep technical logs and delivery records under their own retention schedules.

9. Security

Porcemall uses reasonable administrative, technical and physical measures designed to protect personal information. No website, transmission over the internet or method of storage is completely secure, Porcemall does not guarantee the security of any information, and you provide information at your own risk.

If a breach of security involving personal information, as defined in section 501.171, Florida Statutes, occurs, Porcemall will give the notices that law requires.

10. Children

The Website and the App are intended for adults and are not directed to children under 13. Porcemall does not knowingly collect personal information from children under 13. If Porcemall learns that it has collected personal information from a child under 13, it will delete it. If you believe a child has provided personal information, contact Porcemall at the address below.

11. Your choices and state privacy laws

You may unsubscribe from the newsletter at any time as described above. You may ask Porcemall to access, correct or delete personal information it holds about you by writing to infousa@porcemall.com from the email address associated with that information. Porcemall may need to verify your identity, may decline a request where the law permits, and may keep information it is required or permitted by law to keep.

Porcemall app accounts. To delete an account in the Porcemall app for Android and the data stored with it, email infousa@porcemall.com from the address on the account with the subject "Delete my app account". Porcemall then deletes the account and the details stored with it, namely the sign-in details and the business details entered in the App, except information it must keep to comply with law, resolve disputes or prevent fraud, which is kept only for as long as that purpose requires. Uninstalling the App does not delete the account.

State privacy laws. The Florida Digital Bill of Rights (sections 501.701 to 501.722, Florida Statutes) applies only to businesses with more than US$1 billion in global gross annual revenue that meet further conditions, and it does not apply to Porcemall. Based on its size and activities, Porcemall does not believe that the consumer privacy laws of other states apply to it. Where a privacy law does apply and gives you a right with respect to your personal information, Porcemall will respond to a verified request as that law requires.

12. Changes

Porcemall may change this Privacy Policy at any time by posting the revised version on this page with a new effective date. A revised version takes effect when it is posted. Continued use of the Website or the App after a revision is posted constitutes acceptance of it.

13. Language

This Privacy Policy is written in English and translated into Spanish for convenience. If the two versions differ or conflict, the English version controls.
